Xockets Sues Nvidia and Microsoft for Patent Violations and Conspiracy

AI startup Xockets sues Nvidia and Microsoft for patent infringement, forming a buying cartel. Find out more information on the case and the claims made.

Introduction:

AI start-up Xockets based in Texas has sued tech goliaths Nvidia and Microsoft for patent violation of data processing unit (DPU) technology. Xockets also has accused both Nvidia and Microsoft of influencing the prices and monopolizing the AI market, to form a cartel. Let’s take a closer look at the most significant information about this case.

Allegations of Patent Infringement:

Xockets says that since 2017, Nvidia has been using its patented DPU technology, which speeds up data-heavy computations and improves cloud platforms. To this, the startup says that Nvidia acquired Mellanox some time ago in 2020, and thus inherited this infringement. Xockets claims that Mellanox commenced its act of infringement after this new-age startup began pitching its DPU technology in 2015.

According to Xockets, the startup manages patents involving Nvidia’s BlueField, ConnectX, and NVLink Switch products. Moreover, the case also states that Microsoft, being an Nvidia customer, has ‘privileged access’ to these AI systems that the lawsuit alleges are infringing.

Cartel accusations:

Besides patent violation, Xockets has alleged that Nvidia and Microsoft are involved in a buying cartel that monopolizes the AI hardware business. This cartel was made through RPX, which was founded by Big Tech, to increase the prices of GPU-enabled servers for AI by Nvidia and Microsoft; this is important to Xockets for regulating access to generative AI.

According to Xockets, this alleged cartel comprised Nvidia and Microsoft colluding to boycott innovative technologies, such as Xockets’ DPU, to affect price reduction. They were able to acquire majority stakes in these institutions, placing them at strategic vantage points that were essential for AI development.

Xockets’ Fight for Justice:

The startup is now claiming that Nvidia has infringed on its patents, the founder of Xockets, Parin Dalal, informed Nvidia’s DPU business vice president about this back in February this year. Xockets is now suing for the infringement of its patents and an order to bar Nvidia and Microsoft from further infringing its patent rights and Antitrust laws.

However, Xockets is optimistic that it shall prevail in the legal case, even though it is suing two of the biggest technology companies in the world. As cited in the case, board member of Xockets Robert Cote, an experienced IP lawyer explained that the company has the resources it needs to contend with these “Goliaths.”
